What is the relationship between payment or non payment of child support and parenting time?
What is the relationship between payment or nonpayment of child support and parenting time? Parenting time and child support are two separate and distinct issues. While there is a relationship in the guideline calculation between the annual number of overnights and what child support should presumptively be, there is no relationship between the exercising of parenting time and the payment of child support. In layman terms, money and parenting are two separate and distinct issues as far as the court is concerned. Both child support and parenting time can be enforced once they're in a court order, but they're enforced somewhat separately. We want to keep money on one side and we want to keep parenting on the other. So payment or non payment of child support does not entitle someone to parenting time, nor does it allow the other party to violate the other party's parenting time.
