Bend Child & Spousal Support Attorneys
Spousal & Child Support Lawyers Serving Bend and Surrounding Communities
Issues of spousal and child support orders are important aspects of most divorce cases, and negotiating the terms of these support payments can lead to protracted legal battles. Depending on the financial health of each spouse, not every divorce will include spousal support payments. However, if a marriage produces minor children, provisions must be made for their care before a divorce can be finalized. It’s not uncommon for these issues to be emotionally charged and difficult to finalize during divorce negotiations. A Bend child and spousal support attorney can help you understand and prepare for your case.
What Does Child Support Include?
Child support orders aren’t simply court-required payments for your children. Payments are just one part of a larger set of provisions made for minor children in a divorce settlement agreement.
Other issues can be part of your child support order, like:
- Healthcare Coverages for Minor Children
- Payment Percentages for Uncovered Medical Expenses
- Other Forms of Insurance or Coverages Related to the Child’s Upkeep
Child support payments can be made in a manner that best suits each party. It can be paid monthly, in an annual lump sum, or quarterly – the only stipulation is that it’s paid to the custodial parent in support of the minor child.
What Does Spousal Support Include?
Spousal support orders depend largely on the financial health of the couple. The court will typically award spousal support when large earning disparities exist between spouses. Oregon doesn’t have a set formula for spousal support, but marriage length, combined earning potential, age, and health are considered in making an award. The goal of spousal support is to help each spouse maintain the standard of living enjoyed before the divorce.
There are three types of spousal support:
- Transitional Support: Payment to fund school or training programs to help a spouse transition to a new career to increase earning power.
- Maintenance Support: Monthly payments to help a spouse maintain their marital standard of living.
- Compensatory Support: Repayment of expenses incurred during the marriage in support of the higher-earning spouse’s career.
